1. WHO?

This data protection policy regulates the processing of personal data by DEWIT LAW OFFICE, the entity responsible for processing, with registered office at 1050 BRUSSELS, place Albert Leemans, 20, whose business number is VAT BE0478384006, and which has appointed Mrs Rosanna CONTINO as the processing contact person: rosanna.contino@dewitlawoffice.be

2. WHAT DATA?

The General Data Protection Regulation defines the term « personal data » as follows:
Any information relating to an identified or identifiable natural person (hereinafter referred to as « person concerned »); an « identifiable natural person » is deemed to be a natural person who can be identified, directly or indirectly, in particular by reference to an identifier, such as a name, an identification number, location data, an online identifier, or to one or more specific elements relating to his/her physical, physiological, genetic, psychic, economic, cultural, or social identity.

3. WHAT WILL THE DATA BE USED FOR?

A lawyer acts as legal counsel, legal representative, or for other purposes, and must hold various types of information, documents, and personal data for the proper performance of his/her work.
In the context of interaction with the authorities, bailiffs, and legal professionals, it is possible that personal data may have to be communicated.
The personal data of our clients are processed only as part of the assignments entrusted to DEWIT LAW OFFICE. In addition, all data is subject to professional secrecy, and is not transmitted to any third party.

4. PROCESSING TIME

DEWIT LAW OFFICE keeps the personal data of the various parties at least during the periods of the assignments entrusted to it.
There are various obligations and protections applicable in the context of legal files, such as professional secrecy and the duty of professional preservation. There are legitimate interests that require the retention of personal data after the closure of the files.
DEWIT LAW OFFICE confirms that the processing of your personal data will be limited to what is strictly necessary in the context of legitimate interests. DEWIT LAW OFFICE is bound by professional secrecy and personal data is included in this framework.

5. SECURITY MEASURES

DEWIT LAW OFFICE has implemented technically and organisationally appropriate security measures to prevent destruction, loss, falsification, alteration, unauthorised access by third parties or misleading third parties of the personal data collected, as well as any unauthorised processing of such data.
DEWIT LAW OFFICE has also opted for software for law firms (Dlex Wolters Kluwer) within which all the office’s data is protected by passwords. Together with our IT partner, different technical measures have been taken in the organisation and infrastructure of our systems.

6. RIGHTS OF DATA SUBJECTS

You have the right at any time to consult your personal data for free, as well as to be made aware of the use that DEWIT LAW OFFICE makes of this data.

6.1 Right of modification, deletion, and limitation

You are free to communicate your personal data to DEWIT LAW OFFICE. In addition, you have the right to ask DEWIT LAW OFFICE SPRL to correct, add to, or delete your personal data at any time. You acknowledge that in case of refusal of communication or request for deletion of personal data, we may not be able to provide you with certain services.

You may also request the limitation of the processing of your personal data.

6.2. Right to object

You have the right to object to the processing of your personal data for compelling and legitimate reasons.

In addition, you have the right to oppose the use of personal data for direct marketing purposes. If this is the case, you do not even have to give a reason.

6.3 Right of free transfer of data

You have the right to receive the personal data you have provided to DEWIT LAW OFFICE in a structured, commonly used, machine readable format, and to transmit this data to other data controllers.

6.4 Right to withdraw consent

Whenever the processing of data is based on your prior consent, you have the right to withdraw that consent.

6.6 Automated decisions and profiling

The processing of your personal data does not include any profiling, and will not be the subject of automated decisions by DEWIT LAW OFFICE.
